The Agreement is applicable to

• A physician, individual professional, or institution that wishes to be listed or is currently listed on the Website and Malhampatti Application.
• User of the Website and MalhamPatti Application.

This Agreement governs the free services made available by Malhampatti.com on the Website and MalhamPatti Application, including the following:

• Search for Doctors by name, specialization, or any other criteria that may be devised and implemented is made available to Malhampatti.
• The Services may change from time to time in at Malhampatti’s sole discretion, and this agreement shall apply from visit to and use of the Website and MalhamPatti Application to access the Service with all information supplied on the Website and MalhamPatti Application at any given time.

Malhampatti.com deemed with the right to modify or terminate any Doctor or Partner or a Franchisee from being the part of MalhamPatti for any reason and at any time and such modifications shall be informed in writing in our website and MalhamPatti Application or communicating the same message through email. Visitor is advised to read the notifications on a regular basis.

THE TERMS OF USE

Visitor must be 18 years of age or older to register, use the Services, or visit or use the Website and Malhampatti Application in any manner.

THE TERMS OF SERVICE APPLY TO ALL USERS

• MalhamPatti makes reasonable attempts to ensure that the details updated on a regular basis. Despite these efforts, MalhamPatti cannot be held liable for any inaccuracies or omissions that may be contained within the information.

• The Services provided by MalhamPatti or any of its licensors or service providers are provided on a “as is” and “as available” basis, and without warranties or conditions. MalhamPatti does not provide or make any representation, warranty or guarantee, express or implied, about the website and MalhamPatti Application or the services.
• The Website and MalhamPatti Application may contain links to the websites and MalhamPatti Applications of third parties, affiliates, and business partners. MalhamPatti has no control over, and is not liable or responsible for, the content, accuracy, validity, reliability, or quality of such websites and MalhamPatti Applications or made available by/through our Website and MalhamPatti Application. APPOINTMENT BOOKING AND INTERACTION WITH DOCTORS

• Malhampatti does not promise that a patient will receive a confirmed appointment; furthermore, Malhampatti is not liable if a confirmed appointment is later canceled by Doctors or if Doctors are unavailable at the scheduled appointment time.

Without limiting the extent of the foregoing, Malhampatti will not be responsible for

• any incorrect medication or substandard treatment administered by the Doctor(s) or any medical negligence on the part of the Doctor(s);
• any form of annoyance suffered by the visitor as a result of the Doctor’s inability to offer agreed services or to be available at the set time, the Doctor’s no-show, incorrect treatment, or similar problems;
• any wrongdoing or inappropriate behavior on the part of the Doctor or his or her employees;
• Cancellation or rescheduling of a scheduled appointment, as well as any fee adjustments;
• any medical emergencies that may arise as a result of engaging the services of a Doctor selected by the User based on the information accessible on the Website and Malhampatti Application, or with whom the User has scheduled an appointment through the Website and Malhampatti Application.

In addition, Malhampatti shall in no event be liable for any comments or feedback given by anyone in relation to the services provided by another individual. All such feedback should be made in accordance with applicable law. The option for Users to provide feedback remains at Malhampatti’s sole discretion and may be modified or withdrawn at any time.

Malhampatti may moderate such feedback at any time. Malhampatti shall not be obliged to act in any manner to give effect to the content of visitors’ feedback, such as suggestions for delisting of a particular Practitioner from the Website and Malhampatti Application.

NO DOCTOR – PATIENT RELATIONSHIP; NOT FOR EMERGENCY USE

• Please note that some of the content, text, data, graphics, images, information, suggestions, guidance, and other material (collectively, “Information”) that may be available on the Website and Malhampatti Application (including information provided in direct response to your questions or postings) may be provided by individuals in the medical profession. The provision of such Information does not create a licensed medical professional/patient relationship, between Malhampatti and visitor and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition, but this is only provided to assist the visitor with locating appropriate medical care from a qualified doctor.
• It is hereby expressly clarified that, the Information that the visitor obtains or receive from Malhampatti, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the Website and Malhampatti Application is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the Website and Malhampatti Application. In no event shall the Company be liable to any Visitor for any decision made or action taken by you in reliance on such information.

• Malhampatti authorizes the visitor to view and access the content available on or from the Website and Malhampatti Application solely for ordering, receiving, delivering and communicating only as per this Agreement. TERMS OF USE – PRACTITIONERS – (Doctors)

• LISTING POLICY

Malhampatti, directly and indirectly, collects information regarding the Doctor’s profiles, contact details, and practice. Malhampatti reserves the right to take down any Doctor’s profile as well as the right to display the profile of the Doctor’s, with or without notice to the concerned doctor. This information is collected for the purpose of facilitating interaction with the User. If any information displayed on the Website and Malhampatti Application in connection with visitor and visitors profile is found to be incorrect,the visitor is required to inform Malhampatti immediately to enable Malhampatti to make the necessary amendments.

Visitor as a Doctor hereby represent and warrant that Visitor will use the Services in accordance with and shall render the service to other Visitors of the website and Malhampatti Application at any cost. Any contravention of applicable law as a result of your use of these Services is visitors’ sole responsibility, and Malhampatti will have no liability for the same.

PROFILE OWNERSHIP AND EDITING RIGHT

Malhampatti ensures easy access to the Doctor by providing a tool to update their profile with true information by login into their account and be interconnected with the patients. Doctors may send delayed message for his/her appointment or any other such types of messages which shall have implications for giving better service to the customer but if incase it is found with any activity that may hamper or cause damage to the image of Malhampatti then and there the consequences may go severe with time .

Malhampatti doesn’t take any responsibility for cancellation of tickets booked and no refund of paid amount will be done to any of the customer. Malhampatti reserves the right of ownership of all the Practitioner’s profile and photographs and to moderate the changes or updates requested by Practitioners. However, Malhampatti takes the independent decision whether to publish or reject the requests submitted for the respective changes or updates. User hereby represent and warrant that they are fully entitled under law to upload all content uploaded by them as part of your profile or otherwise while using Malhampatti’s services, and that no such content breaches any third party rights, including intellectual property rights.

REVIEWS AND FEEDBACK DISPLAY RIGHTS OF MALHAMPATTI.COM

• Malhampatti reserves the right to collect feedback and Critical Content for all the Practitioners, Clinics and Healthcare Providers listed on the Website and Malhampatti Application.
• Malhampatti reserves the right but shall have no obligation to pre-screen, review, flag, filter, modify, refuse or remove any or all Critical Content from any Service
• Malhampatti reserves the right to moderate, publish, re-publish and use all user generated contributions and comments (including but not limited to reviews) posted on the Website and Malhampatti Application as it deems appropriate (whether in whole or in part) for its product (s), whether owned or affiliated.
• Malhampatti shall not be liable to pay any considerations to any User for republishing any content across any of its platforms.

Without prejudice to the status of other content, Malhampatti will not be liable for the accuracy of information or the claims made in the Sponsored Listings. Malhampatti does not encourage the Users to visit the Sponsored Listings page or to avail any services from them. Malhampatti will not be liable for the services of the providers of the Sponsored Listings.
